  1. ACCEPTANCE OF TERMS

By accessing, browsing, or using the English Explorers website (englishexplorers.cc), mobile applications, or any associated services (collectively, the “Service”), you (“User,” “you,” or “your”) agree to be legally bound by these Terms of Service and Privacy Policy (“Terms,” “Agreement”).

These Terms constitute a legally binding agreement between you and English Explorers (“we,” “us,” “our,” or “Company”).

By clicking “I Agree,” creating an account, making a purchase, or accessing any course content, you confirm that:

  • You have read and understood these Terms
  • You agree to be bound by these Terms
  • You are at least 13 years of age (or have parental consent if younger)

  • Student dashboard and course navigation

Service Availability:
The Service is provided on an “as is” and “as available” basis without any warranty or condition, express, implied, or statutory. We do not guarantee that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • The results obtained from the Service will be accurate or reliable
  • Any errors in the Service will be corrected
  • The Service will meet your specific requirements

We reserve the right to:

  • Modify, suspend, or discontinue any aspect of the Service at any time
  • Change course content, features, or functionality without prior notice
  • Limit access to certain features or content
  • Impose limits on file sizes or storage space

  1. ACCOUNT REGISTRATION AND SECURITY

Account Creation:
To access certain features of the Service, you must create an account by providing:

  • Users under 18 must have parental or guardian consent

Account Termination by User:
You may close your account at any time by contacting us. Closing your account does not entitle you to any refund for purchased courses.

  1. LICENSE GRANT AND RESTRICTIONS

What You Purchase:
When you purchase a course, you are purchasing a limited, non-exclusive, non-transferable, revocable license to access and use the course content for your personal, non-commercial use only.

YOU DO NOT OWN THE COURSE CONTENT. All intellectual property rights remain with English Explorers.

Permitted Uses:
You may:

  • Access course content from multiple personal devices (computer, tablet, phone)
  • Download materials expressly marked as downloadable
  • Take notes and create personal study materials based on course content
  • Print materials for personal study purposes only

Prohibited Uses:
You may NOT:

  • Share, distribute, or reproduce course content in any form
  • Record, screenshot, or capture video/audio lessons
  • Upload course content to any website, platform, or cloud storage
  • Sell, rent, lease, sublicense, or transfer your course access
  • Use course content for commercial purposes
  • Remove or alter any copyright, trademark, or proprietary notices
  • Create derivative works based on course content
  • Use automated tools to access, scrape, or download content
  • Reverse engineer, decompile, or disassemble any software
  • Share your login credentials with others (see Section 6)

Enforcement:
Violation of these license terms will result in immediate termination of your access without refund and potential legal action.

  1. NO REFUND POLICY (DIGITAL PRODUCTS)

ALL SALES ARE FINAL AND NON-REFUNDABLE

Due to the immediate digital nature of our courses, all purchases are final and non-refundable under any circumstances, including but not limited to:

  • Change of mind or buyer’s remorse
  • Lack of time to complete the course
  • Dissatisfaction with course content, teaching style, or difficulty level
  • Duplicate purchases or accidental purchases
  • Technical issues on your device or internet connection
  • Inability to access due to user error or forgotten passwords
  • Course not meeting your expectations
  • Finding alternative resources or courses
  • Financial hardship or change in circumstances

No Partial Refunds:
There are no partial refunds for:

  • Partially completed courses
  • Unused portions of courses
  • Multiple course purchases
  • Bundle or package deals

Why No Refunds:
Our courses are digital products delivered instantly upon purchase. Once you gain access to course content, the product has been fully delivered and cannot be “returned” like a physical product.

INTERNATIONAL COMPLIANCE

For EU/UK/EEA Customers (Consumer Rights Directive / UK Consumer Contracts Regulations):

Under EU and UK law, consumers typically have a 14-day “cooling-off period” to cancel digital content purchases. However, you expressly agree to waive this right.

By purchasing any course and clicking the acknowledgment checkbox at checkout, you:

  • Acknowledge that you have been informed of your 14-day cancellation right
  • Expressly request immediate access to the digital content
  • Understand that once immediate access is granted, you waive your right to cancel
  • Agree that the performance of our service begins immediately
  • Consent to losing your cancellation right upon accessing course content

This waiver is required under Article 16(m) of the Consumer Rights Directive 2011/83/EU and the UK Consumer Contracts Regulations 2013.

For Australian Customers:
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement. However, Australian Consumer Law does not provide a right to refund for digital content simply due to change of mind.

For Other Jurisdictions:
To the extent permitted by applicable law, all sales are final. Where local consumer protection laws provide mandatory refund rights that cannot be waived, those rights will apply, but only to the minimum extent required by law.

ALTERNATIVES TO REFUNDS

Preview Before Purchase:
We strongly encourage you to:

  • Review free preview lessons (where available)
  • Read course descriptions, curriculum, and learning objectives
  • Review student testimonials and reviews
  • Contact us with any questions before purchasing

Technical Support:
If you experience technical difficulties accessing your course:

  • Contact admin@englishexplorers.cc immediately
  • We will work to resolve technical issues promptly
  • Technical support does not entitle you to a refund

Exceptional Circumstances:
In rare cases of platform failure or if we are unable to deliver the service for reasons within our control, we may, at our sole discretion, offer:

  • Course credit toward another course
  • Extended access period
  • Resolution of technical issues

This does not constitute a refund policy and is offered only at our discretion.

CHARGEBACK PROHIBITION

Filing a chargeback or payment dispute for a valid purchase constitutes fraud and breach of contract. If you file a chargeback:

  • Your account will be immediately terminated
  • You will be permanently banned from the platform
  • We will contest the chargeback with evidence of service delivery
  • We reserve the right to pursue legal action for fraud
  • You will be responsible for all costs and fees incurred

Proper Dispute Process:
If you have a legitimate concern about a purchase, you must contact us directly at admin@englishexplorers.cc before initiating any payment dispute.

  1. ACCOUNT SHARING AND USAGE RESTRICTIONS

SINGLE USER LICENSE

Each course enrollment is licensed for individual use only. One account = one person.

What IS Allowed:

  • Accessing your account from multiple personal devices (your computer, phone, tablet)
  • Switching between devices as needed
  • Using different browsers or apps
  • Accessing from different locations (home, work, while traveling)

What IS NOT Allowed:

  • Sharing your login credentials with anyone else
  • Allowing family members, friends, or colleagues to use your account
  • Creating group accounts for multiple users
  • Simultaneous logins from different people
  • Using your account in a classroom or group setting without proper licensing
  • Providing access to course materials to non-enrolled users

CONCURRENT SESSION LIMITS

To prevent abuse while allowing legitimate multi-device use, we limit accounts to 2 concurrent active sessions. If you attempt to log in from a third location, the oldest session will be automatically terminated.

Example of Legitimate Use:

  • You’re logged in on your laptop at home (allowed)
  • You start a lesson on your phone while commuting (allowed)
  • Both sessions are YOU = Allowed

Example of Violation:

  • You’re logged in at home (allowed)
  • Your friend logs in from another city at the same time (violation)
  • Multiple simultaneous logins from different locations = Account Sharing

DETECTION AND ENFORCEMENT

We actively monitor for account sharing through:

  • Login patterns and IP address analysis
  • Simultaneous access from geographically distant locations
  • Unusual usage patterns
  • User reports and security audits

Penalties for Account Sharing:

First Violation:

  • Warning email sent to account holder
  • All active sessions forcibly logged out
  • Account temporarily suspended for 24 hours

Second Violation:

  • Account suspended for 7 days
  • Formal written warning
  • Required password reset and security review

Third Violation or Severe Abuse:

  • PERMANENT account termination
  • NO REFUND for any purchased courses
  • PERMANENT BAN from creating new accounts
  • Potential legal action for copyright infringement

EDUCATIONAL INSTITUTION LICENSING

If you are a school, organization, or business wishing to provide access to multiple users:

  • Contact us for group or institutional licensing
  • Standard individual licenses may NOT be used for group instruction
  • Violation of this policy will result in immediate termination and legal action

  1. COURSE ACCESS AND DURATION

Access Period:
Unless otherwise specified at the time of purchase:

  • Most courses provide lifetime access as long as the course remains available
  • Some specialized courses may have time-limited access (clearly stated before purchase)
  • “Lifetime” means for the life of the course, not your lifetime

Our Rights:
We reserve the right to:

  • Update, modify, or improve course content at any time
  • Discontinue courses with 30 days’ notice (you’ll retain access to existing content)
  • Remove or replace instructors
  • Change course structure or curriculum
  • Migrate to new platforms or technologies

If We Discontinue a Course:

  • Active students will receive 30 days’ notice when possible
  • You’ll be provided reasonable time to complete and download materials
  • We may offer comparable alternative courses
  • No refunds for discontinued courses

Platform Changes:
We may migrate to new learning platforms, update technology, or change service providers. You agree to:

  • Accept platform migrations and technology updates
  • Create new accounts on updated platforms if required
  • Acknowledge that some features may change or be unavailable
  • No compensation for platform changes

No Guarantee of Availability:
While we strive to maintain course availability, we do not guarantee:

  • Permanent access to any specific course
  • Availability of historical versions of updated courses
  • Preservation of all original features or content
  • Uninterrupted access during platform maintenance

  1. PAYMENT TERMS

Accepted Payment Methods:
We accept payment through our payment processors, which may include:

Currency:

Failed Payments:

  • Persistent payment failures may result in account suspension

Taxes:
You are responsible for all applicable taxes, duties, and government fees. Prices may not include:

Subscription or Recurring Billing (if applicable):

You agree NOT to engage in any of the following prohibited activities:

Content Theft and Copyright Violation:

  • Sharing, distributing, or posting course content on any platform
  • Creating unauthorized copies or derivative works
  • Selling, licensing, or commercializing course content
  • Uploading course materials to file-sharing or torrent sites

Platform Abuse:

  • Using automated scripts, bots, or scrapers to access the Service
  • Attempting to gain unauthorized access to any part of the Service
  • Interfering with or disrupting servers or networks
  • Bypassing security measures or technological protection measures
  • Reverse engineering or attempting to extract source code
  • Introducing viruses, malware, or malicious code

Account Abuse:

  • Creating multiple accounts to abuse free trials or promotions
  • Impersonating others or providing false information
  • Selling, renting, or transferring your account
  • Sharing login credentials (see Section 6)
  • Using the Service for any illegal purpose

Misuse of Service:

  • Posting spam, advertisements, or unsolicited content
  • Harassing, threatening, or abusing other users or instructors
  • Posting offensive, defamatory, or inappropriate content
  • Violating any applicable laws or regulations
  • Using the Service to infringe third-party intellectual property rights

Commercial Misuse:

  • Using course content for commercial training without authorization
  • Incorporating course materials into paid products or services
  • Reselling access or acting as an unauthorized reseller
  • Using the Service for competitive analysis or creating competing products

Violation Consequences:
Engaging in prohibited activities will result in:

  • Immediate termination of your account
  • No refund for any purchased courses
  • Permanent ban from the platform
  • Potential legal action and liability for damages
  • Reporting to relevant authorities if illegal activity is suspected

Ownership:
All content on the English Explorers platform, including but not limited to:

  • Course curriculum, lesson plans, and educational materials

  • Trademarks, service marks, and trade names
  • The “English Explorers” name and brand

…is the exclusive property of English Explorers and is protected by:

  • Copyright laws (local and international)
  • Trademark laws
  • Trade secret laws
  • Other intellectual property laws and treaties

Your Limited License:
As stated in Section 4, you receive only a limited, non-exclusive, non-transferable license to access course content for personal use. This license does not grant you any ownership rights.

Trademarks:
“English Explorers” and associated logos are trademarks of English Explorers. You may not use these trademarks without our prior written consent.

Copyright Infringement:
We respect the intellectual property rights of others and expect users to do the same. If you believe your copyrighted work has been infringed upon on our platform, please contact us at:

Data Upon Termination:
After termination:

  • We may delete your account data in accordance with our data retention policies
  • You may request a copy of your data before termination (subject to Section 25)
  • We have no obligation to maintain or provide your data after termination

No Warranty of Service:
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Title
  • Quiet enjoyment
  • Accuracy or completeness of content

No Guarantee of Availability:
We do not warrant that:

  • The Service will be uninterrupted or error-free
  • Defects will be corrected
  • The Service is free from viruses or harmful components
  • Your access will never be suspended or terminated

Third-Party Content:
We are not responsible for:

  • Third-party websites, services, or content linked from our Service
  • Accuracy or availability of third-party materials

Technical Limitations:

  1. LIMITATION OF LIABILITY

IN NO EVENT SHALL ENGLISH EXPLORERS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Loss of use or loss of goodwill
  • Business interruption
  • Personal injury or emotional distress
  • Any damages arising from your use or inability to use the Service

Even if:

  • We have been advised of the possibility of such damages
  • A remedy fails of its essential purpose
  • Damages result from our negligence (to the extent permitted by law)

Maximum Liability:
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF:

  • The total amount you paid us in the 12 months preceding the claim, OR
  • USD $100

This limitation applies:

  • Regardless of the legal theory (contract, tort, negligence, strict liability, etc.)
  • Even if we have been advised of the possibility of damages
  • To all claims collectively, not per incident

Exceptions:
The above limitations do not apply to:

  • Death or personal injury caused by our gross negligence or willful misconduct (where applicable law prevents limitation)
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot be excluded or limited by law

Australian Consumers:
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot be lawfully excluded. If the Australian Consumer Law applies, our liability for breach of a consumer guarantee is limited to, at our option:

  • Re-supply of the services, or
  • Payment of the cost of re-supply

EU/UK Consumers:
Where EU or UK consumer protection law applies, nothing in these Terms affects your statutory rights that cannot be excluded or limited by contract.

  1. INDEMNIFICATION

Your Agreement to Indemnify:
You agree to defend, indemnify, and hold harmless English Explorers, its officers, directors, employees, agents, licensors, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from or related to:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property rights
  • Your User Content or any content you post
  • Your account sharing or unauthorized access
  • Any fraudulent or illegal activity connected to your account
  • Any misrepresentation made by you
  • Your violation of applicable laws or regulations

Cooperation:
We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you. You agree to cooperate fully with us in asserting any available defenses.

This indemnification obligation survives termination of these Terms and your use of the Service.

  1. DISPUTE RESOLUTION AND GOVERNING LAW

Governing Law:
These Terms shall be governed by and construed in accordance with the laws of Thailand, without regard to its conflict of law provisions.

Jurisdiction:
Subject to the arbitration provisions below, you agree that any legal action or proceeding arising from or relating to these Terms or your use of the Service shall be brought exclusively in the courts located in Thailand, and you consent to the personal jurisdiction of such courts.

Informal Resolution:
Before initiating any formal dispute resolution, you agree to first contact us at admin@englishexplorers.cc and attempt to resolve the dispute informally. We will make good faith efforts to resolve disputes amicably.

Dispute Resolution:
Any dispute arising from or relating to these Terms or the Service shall be resolved in the courts specified above.

Class Action Waiver:
